At its session on Thursday (14), the National Congress rejected a complete veto on the bill Act No. 1949/2021which provides for the exclusion from the payment of risk pay for drivers of vehicles equipped with an additional fuel tank (VET 34/2023). The case will be forwarded for announcement.
The draft by the Chamber of Deputies received a positive opinion from the rapporteur of the Committee on Infrastructure Services (CI), Senator Carlos Viana (Podemos-MG). In October, the matter was approved at the plenary and received presidential sanction.
Draft – adding provisions to the Consolidation of Labor Law (CLT – Law Decree No. 5452 of 1943) – excludes from the payment of risk remuneration to drivers the transport of fuel in original factory tanks and additional tanks for the needs of the freight vehicle itself, public passenger transport, machinery and equipment.
By vetoing the bill, the Executive Branch stated that the legislative proposal was contrary to the public interest because it would establish from a legal point of view hypotheses for characterizing the hazards of activities and operations, without objectively indicating criteria and parameters for the quantities of flammable liquids or gases, liquefied materials that can be transport in a way that guarantees the protection and safety of employees in the freight and passenger transport sector, contrary to labor law provisions.
